Short version: Your health data belongs to you. Stored in HIPAA-eligible infrastructure. Never sold. Payment via Stripe — your care records never touch Stripe.

1. Who We Are

CareRelay, Inc. operates the CareRelay mobile and web platform — a care coordination service connecting families, home caregivers, and healthcare organizations. We are a HIPAA-covered entity and take our obligations under HIPAA, HITECH, and applicable state privacy laws seriously.

2. Information We Collect

Account Information (Not PHI)

  • Your name and email address
  • Subscription tier and billing status (via Stripe only)
  • Your role in the care team
  • Device type and app version

Protected Health Information (PHI)

  • Care recipient name, age, and medical conditions
  • Medications, dosages, and administration records
  • Vital signs and health measurements

4. How We Use Your Information

Account information is used to manage your subscription and send transactional emails. PHI is used exclusively to provide care coordination services, generate audit trails, and power the AI Care Assistant through HIPAA-eligible AI infrastructure. We never sell your information. We never use PHI for advertising.

5. Data Sharing

We share PHI only with: (1) members of your Care Circle whom you explicitly invite, (2) healthcare providers when you initiate a handoff, and (3) our HIPAA-BAA-covered infrastructure providers. We never share PHI with data brokers, advertisers, or any unrelated third party.

6. Data Retention

Even if you cancel, care records are retained for a minimum of 6 years as required by HIPAA. You lose app access but records are preserved and exportable at any time by contacting privacy@carerelay.app.

7. Security

1. Acceptance

By creating a CareRelay account or using the service, you agree to these Terms. If you do not agree, do not use CareRelay.

2. What CareRelay Is (and Isn't)

CareRelay is a care coordination platform. CareRelay is NOT a medical provider and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions. In an emergency, call 911 immediately.

3. Subscriptions & Billing

Family Pro — $9.99/month or $95.88/year

  • 14-day free trial with credit card required upfront
  • Automatically converts to paid after trial — you will be reminded 3 days before
  • Cancel any time — access continues until end of billing period

Hospital & Agency — $149/month per facility

  • Requires demo call before activation
  • HIPAA Business Associate Agreement required and included

Billing Policies

  • All prices in USD. Applicable taxes may apply.
  • Failed payments: 7-day grace period with automated retry
  • Refund requests within 7 days of any charge honored — billing@carerelay.app

4. Cancellation

Cancel via the app, the Stripe Customer Portal, or by emailing support@carerelay.app. Care records are NEVER deleted upon cancellation — retained 6 years minimum per HIPAA.

5. Legal & Insurance Records

CareRelay generates timestamped, tamper-evident records. Users acknowledge: CareRelay records are not self-authenticating legal documents; an attorney should review before use in legal proceedings; CareRelay does not provide legal advice; accuracy depends on information entered by users.

6. Prohibited Uses

  • Entering false or fabricated care records
  • Impersonating healthcare professionals without proper credentials
  • Sharing another person's PHI without their explicit consent
  • Any unlawful purpose

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARERELAY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. CARERELAY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

CareRelay is required by law to maintain the privacy of your protected health information (PHI), provide you with this notice, and notify you following any breach of unsecured PHI.

Permitted Uses of Your PHI

For Care Coordination

We use PHI to facilitate care coordination between family members, home caregivers, and healthcare providers — the primary purpose of CareRelay.

Required by Law

We may disclose PHI when required by federal or state law, such as in response to a valid court order.

We Will NOT Use PHI For

  • Marketing without your explicit written authorization
  • Sale to third parties — ever, under any circumstances
  • Any purpose not directly related to providing CareRelay services

Your Rights

  • Right to Access: Request a copy of your PHI — provided within 30 days
  • Right to Amend: Request corrections to inaccurate PHI
  • Right to Restrict: Request restrictions on how we use your PHI
  • Right to Accounting: Request a list of disclosures we've made
  • Right to Complain: File with HHS at hhs.gov/hipaa/filing-a-complaint — no retaliation

If we discover a breach of your unsecured PHI, we will notify you within 60 days of discovery with full details and remediation steps.

What is a BAA?

A Business Associate Agreement is a contract required under HIPAA between a Covered Entity (your hospital or agency) and a Business Associate (CareRelay) whenever CareRelay accesses, processes, or stores Protected Health Information on your behalf.
